At Dinerware, Inc. we value your privacy. The following describes the methods by which we gather information and our practices for sharing that information within our company and partner network. This Privacy Policy sets forth how information you provide is used by the Dinerware.com (“Site”) and its owner, Dinerware, Inc. Please read this Privacy Policy to learn more about the ways in which we use and protect your information. By visiting our Site or using our services, you are consenting to the information collection and use practices described in this Privacy Policy, as modified from time to time by us. If you do not agree, please do not use our services or access our Site. We may amend this Privacy Policy at any time by posting the amended terms on the Site. All amended terms will automatically be effective seven (7) days after they are initially posted on the Site. Therefore, we encourage you to check the date of our Privacy Policy whenever you visit the Site for any update or changes.

In general, you may visit the Site without telling us who you are or revealing any information about yourself or your company. We only collect information identifiable to you or your company that we consider necessary for providing our services to you. At a minimum, such identifiable information includes your e-mail address. In addition, you may want to provide other information, such as your full name, office address, town or city, state, zip code, or telephone number. You agree that we may also use the information you provide, including personally identifiable information, to analyze Site usage, improve our offerings, customize the Site's content, layout, and services, and better tailor it to meet your needs.

We receive and store certain types of information anytime you interact with us. Dinerware.com is built on the DNN framework, which automatically logs site visits, page views, and other information. Google Analytics also tracks site visits and page views, as well as demographic information such as geographic location and reference source. This can include: your IP address, browser type, domain names, access times and referring Web site addresses. This information is used by Dinerware.com for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Site. This information is stored as abstract use data and is not cross-referenced or identified in any manner to any information you may choose to provide us regarding you or your company.

Like many web sites, we use "cookies," alphanumeric identifiers that we transfer to your computer's hard drive through your web browser to enable our systems to recognize your browser. Cookies enable us to provide quicker access to some Site features without requiring you to re-enter your personal information. The cookies we use are both persistent and durable, meaning they exist as long as you do not delete them from your computer’s hard drive and "session cookies," which means that they automatically expire at the end of a browser session and, consequently, do not persist on your hard drive. In addition, you are always free to decline our cookies if your browser permits this functionality. However, if you decide to do so, you would not be able to establish a logged-in session with Dinerware.com and would not be able to use many of the features on the Site.

E-mail. We use generally use e-mails in three ways:

(1) We will send you an e-mail to confirm or deliver a Dinerware license key, or provide other information needed to use our services;

(2) We send e-mails to let you know about new features and product offerings, and to deliver communications relevant to your use of the Site, such as administrative notices if you elected during registration to “opt-in” to receiving such e-mails. If you later decide that you don’t wish to continue to receive these communications, please use the link at the bottom of the email to unsubscribe from the mail list; and

(3) Should you decide to download our software or request more information, ee send e-mails to follow up on your interest in Dinerware. In some cases, we may pass your information along to a partner in your area.

As a matter of policy, we do not sell or rent any of your personal information to third parties (for example, advertisers) for their marketing purposes without your explicit written consent. When Dinerware collects personal information through forms, like your email address or zip code, we use that information to fulfill your request, such as sending you the Trial Download instructions. We may also use that information as follows:

Dinerware Partners: Dinerware products are sold through a network of reseller partners, and we share, and you agree that we may, your information with our partner network when appropriate. In addition, Dinerware or a member of its partner network may use your contact information to tell you about products or services we think might interest you. We do not restrict their use of your information and are not, and you agree that we are not, liable for their use or misuse of it. Legal Requests: In response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, Dinerware may (and you authorize us to) disclose information you have provided, such as your name, city, state, telephone number, email address, user id, history, and other relevant information, without a subpoena. Without limiting the above, Dinerware will not ordinarily disclose your personal information to law enforcement or other government officials without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss, or report suspected illegal activity.

Dinerware.com secures the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When personal information (such as contact information) is transmitted to other Web sites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol. However, no data transmission over the Internet or information storage technology can be guaranteed to be 100% secure. Dinerware does not guarantee or warrant that the information will not be stolen or accidentally disclosed. You are providing such information at your own risk.
